Adtomatic Digital Pte. Ltd. (“Adtomatic”, “we”, “us”, or “our”) is a company registered in Singapore. We provide software-based digital solutions for Singapore small and medium-sized businesses, including:

• InstaReview.ai — an AI-powered voice feedback and reputation management platform.
• Cyber Essentials — a self-guided PDPA compliance software platform for training Data Protection Officers (DPOs), conducting internal gap analyses, completing compliance checklists, and receiving compliance alerts.

These Terms govern your access to and use of our software platforms, websites, and any related services (collectively, the “Services”).

Our Services are software tools and educational platforms. They are designed to assist businesses in managing customer feedback, improving internal processes, and building awareness of data protection obligations under Singapore's Personal Data Protection Act (PDPA).

Our platforms are not designed, intended, or authorised for the storage of personal data or Personally Identifiable Information (PII) of any individuals. Customers must not use our platforms as a data repository, database, or archival system for personal data.

Cyber Essentials provides guidance, checklists, and training tools to assist your organisation in working towards PDPA compliance. It does not constitute legal advice, and use of the platform does not guarantee full compliance with the PDPA or any other applicable legislation.

Specifically, you agree and acknowledge that:

• Our platforms are not intended to store personal data or PII of your customers, employees, or any third parties. You must not input, upload, or transmit personal data through our platforms except as strictly necessary for the intended function of the service.
• You are responsible for obtaining all necessary consents from individuals whose data you collect or process in connection with our Services.
• You are responsible for ensuring your organisation's own compliance with the PDPA and any other applicable data protection laws, regardless of your use of Cyber Essentials or any other Adtomatic service.
• You are responsible for implementing appropriate technical and organisational measures to protect any personal data within your control.
• You must not use our Services to process sensitive personal data (including medical records, financial account information, or government identity numbers) unless expressly agreed in writing by Adtomatic.

Without limiting the generality of the above, Adtomatic expressly disclaims liability for:

• Any breach, leak, or unauthorised access to personal data that you or your organisation store, process, or transmit through or in connection with our platforms.
• Any loss, damage, or regulatory penalty suffered by you or any third party as a result of your failure to comply with the PDPA or any other applicable data protection law.
• Any failure by your organisation to implement adequate data protection measures, regardless of whether you have used Cyber Essentials or any other Adtomatic service.
• Data entered into our platforms by your team members, agents, or third parties acting on your behalf.
• Any loss or damage arising from third-party systems, integrations, or services connected to our platform.

Adtomatic's total liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the total fees paid by you to Adtomatic in the three (3) months immediately preceding the claim.

InstaReview.ai captures voice recordings submitted by your customers for the purpose of generating real-time sentiment analysis and feedback insights. The following applies:

• Voice recordings are processed by AI for transcription and sentiment analysis and are not retained as permanent records of identified individuals.
• You are responsible for informing your customers that feedback is collected via InstaReview.ai and for displaying appropriate notices at points of collection.
• You must not direct InstaReview.ai to collect personal data beyond what is necessary for genuine feedback purposes.
• Adtomatic is not responsible for any claims arising from your customers regarding the collection or processing of their voice or feedback data where you have failed to provide adequate notice or obtain appropriate consent.

Cyber Essentials is a self-guided software tool that assists organisations in building internal PDPA compliance processes. It is important that you understand the following limitations:

• Cyber Essentials does not constitute legal or regulatory advice. You should seek independent legal counsel if you require advice specific to your legal obligations.
• Completion of Cyber Essentials checklists, training modules, or gap analyses does not guarantee that your organisation is fully compliant with the PDPA or any other law.
• Adtomatic makes no warranty that the content of Cyber Essentials is complete, accurate, or current. PDPA guidelines may be updated by the PDPC at any time, and it is your responsibility to monitor and respond to regulatory changes.
• Adtomatic shall not be liable for any regulatory penalty, enforcement action, or third-party claim arising from your reliance on Cyber Essentials as your sole compliance measure.

All content, software, trademarks, and materials provided through our Services are the intellectual property of Adtomatic Digital Pte. Ltd. or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@adtomatic.com if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate your access to our Services at any time if you breach these Terms or use our platforms in a manner inconsistent with their intended purpose, including using them to store personal data or PII contrary to clause 2 and 3 above.

These Terms shall be governed by and construed in accordance with the laws of Singapore. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised “Last updated” date. Continued use of our Services after such changes constitutes your acceptance of the updated Terms.
